Poison The Well’s Van, Gear Stolen

On only the second day of their tour with Billy Talent, Florida’s Poison the Well woke up in Detroit to find their van and all of their gear stolen.

“So this morning we woke up at our delightful Marriot Courtyard hotel (priceline, get into it) and walked outside to get in the van to head to Chicago for our second show of the tour. Only problem, it isn’t there. Either someone is pulling some Merlin shit on us and just waiting for the perfect moment to unveil it and calm our shot nerves, or a talented scumbag stole our van and trailer with literally everything we own inside. Needless to say, we’re crushed. Our most beloved instruments are gone, and trust me, we’re gear nerds.

After a great deal of scrambling and deliberation, we found a way to stay on tour, after a few days off to get some gear and a rental van together. Having something like this happen is the worst thing that can happen to any band short of someone dying, and we’re incredibly stoked to finish this tour with Billy Talent and play every night doing what we love.

Our most sincere thanks to everyone who offered to help us in any way, our friends mean the world to us and everyone who has reached out today is absolutely mind blowing. Huge huge ups to Adam, Dave, and Jackie at Yeah!, the entire Ferret Records Family (Carl cause hes got the cash and Rick cause he calls the shots), Issac and the entire Indie Merch and Jakprints family, Tour Dog Leasing and Rental (thanks for driving to detroit to come get us), Jimmy and First Act Guitars, Russel Blair and Orange Amps, Derek at Ernie Ball, Tyme Rogers and Tech 21, Evan Obrien and Korg, Scott Uchida and Jim Dunlop, Jon “Shabba on the spot” Linton, John “Badge” Chidley. Some of these people have always helped us out and are further making our lives better. Some of these people barely know us and have helped us this with this shit time.

Royalty Groups Pressing Online Stores For Performance Fees On 30-Second Samples, Downloads

From the douchery files: music royalty groups ASCAP and BMI are pressing iTunes and other online music stores to pay performance fees on 30-second song previews available when shopping for music, as well as individual downloads of songs and TV shows and movies featuring their artists’ music.

Yes, this is insane, and it’s ASCAP and BMI desperately trying to share someone else’s piece of the pie. Performance royalty groups have no direct financial interest in music sales, as their business only pertains to when music is performed in public – on the radio, at restaurants, sports stadiums, etc. These groups collect fees and pass it on to composers and songwriters. This is different than when music is sold at retail, when “mechanical” royalties are paid to labels who then distribute the revenue.

So, ASCAP and BMI are arguing that a download is the same as a radio play and therefore a public performance fee should be paid in addition to the standing distribution agreements. However the Digital Music Association, an online media industry defender that counts Apple, RealNetworks and others among its members, counter that legal precedent has already been set that considers downloads private and therefore exempt from performance fees. ASCAP has appealed this decision and the case will be heard later this year.

The really silly (and what will be very controversial) bit is the issue over 30-second samples. iTunes has acquired licenses allowing previews without paying for them, but the groups are trying to change. From a legal standpoint, it can be argued that streaming 30 seconds is no different than streaming an entire song from a site like Pandora (which does have to pay performance royalties).

None of this really affects the consumer unless (or rather, until) the cost of additional royalty fees is passed on in the form of higher prices. This is really more just different factions of the music industry fighting to get a taste of the action. Performance royalty groups see that Apple is the only place still making money off music, and they want to force their way in. It’s highly unlikely the downloads-as-public-performances thing will fly, it’s simply a modern day purchase method – downloading a song from iTunes is the same act as unwrapping a CD you’ve just purchased. But the streaming previews issue could get hairy, and it’s something we’ll keep an eye on. Of course if ASCAP and BMI get their way, iTunes will likely just stop using previews before they pay another dime.

The rapidly rising indie label Sargent House is offering a free sampler of its diverse roster of bands beginning this week via AmazonMP3. The 12-song compilation features tracks by RX Bandits, Bygones (Zach Hill & Nick Reinhart), Good Old War, Maps & Atlases, Tera Melos and Red Sparowes. The label sampler includes two singles currently at radio, "My Lonesome Only Friend" (MP3) by RX Bandits and "Looking For Shelter" (MP3) by Good Old War. See full track listing below.

Sargent House is a Los Angeles based management company and record label. It was founded in June 2006 by Cathy Pellow who also owns music video production company and syndicated television show Refused TV. Pellow began managing the metamorphic rock outfit RX Bandits in 2006. The band needed to release its new album ...And The Battle Begun so Pellow decided to launch her own record label (largely out of interest in doing things differently from the traditional model of record labels.) From that point onward, Pellow continued to manage bands and release records, all under the Sargent House banner.

Listed chronologically from when Pellow first began working with them, Sargent House currently manages the RX Bandits, These Arms Are Snakes, Maps & Atlases, Russian Circles, Tera Melos, Daughters, Red Sparowes, Red Fang, Good Old War, Native, Bygones, Zechs Marquise and Zach Hill. Additionally, Pellow also helms the Rodriguez Lopez Productions imprint, founded by The Mars Volta guitarist Omar Rodriguez-Lopez. Sonny Kay came from the Gold Standard Labs label as art director for Rodriguez Lopez Productions (RLP) and Sargent House. RLP launched in March 2009, with its first release by El Grupo Nuevo de Omar Rodriguez Lopez titled Cryptomnesia out in May 2009.

Currently, all Sargent House managed bands also have a release on the SH label. Drummer Zach Hill is the most recent management and label signing. His next solo album, Face Tat is slated for release on Sargent House.
